The Criminal Mediation System is a service promoted by the Ministry of Justice, which is based on the management of geographically organized lists of criminal mediators, previously trained in Criminal Mediation. In the Inquiry phase of the criminal procedure, the Public Prosecution Service forwards the case, ex officio or at the request of the defendant and the offended party, to Criminal Mediation. The defendant and the offended party can request clarification from the SMP, by telephone or email. Once the defendant and the offended party have been contacted, an information session is scheduled with the presence of the mediator, to be held in rooms available for this purpose. The defendant and the offended party are informed about the mediation rules, rights and duties and other required information. Then the willingness of both the defendant and the offended party to sign the consent form, which must be signed, is verified. Mediation sessions follow.
